How long does it take to close on a house in Monroe County NY after an accepted offer?

In Monroe County, contracts for financed purchases are commonly written to close about 45 to 60 days after acceptance. The first few business days are the attorney approval period, when either attorney can request changes. Inspections, title work, the appraisal and mortgage commitment fill the middle. Cash purchases can close much sooner, often in weeks.

Your offer was accepted. Congratulations, and now the calendar starts. This post walks through what happens between that acceptance and the day the deed gets recorded at the Monroe County Clerk's Office: the attorney approval period, inspections, title, the appraisal, the mortgage commitment and the walkthrough. You will see who controls each step, which dates are hard deadlines and which are targets, and what tends to push a closing back in Henrietta, Pittsford, Brighton, Mendon, Rush and Honeoye Falls.

One note before we start. Contract conventions below are how deals are structured here, not market statistics. Where I quote a number from the market, I name the source and the reporting period.

What is the attorney approval period in New York?

The attorney approval period is a short window at the start of the contract during which either side's attorney can review the signed agreement, ask for changes, or disapprove it entirely. In New York, unlike many states, attorneys run residential closings, and the purchase contract used across the Rochester region includes this contingency by design. It is written as a stated number of business days, commonly three, counted from the date of acceptance. Read your own contract, because the count and the deadline date are spelled out on the page.

Here is what people misunderstand. During attorney approval, the contract is not fully binding. An attorney can disapprove for almost any reason. In practice, disapproval is rarely used to blow up a deal. It is used to fix language, adjust dates, add a condition, or hold the file open while the inspection results come in.

What typically happens in that window:

  • Both attorneys read the contract and confirm the terms match what was negotiated.
  • The buyer schedules a home inspection, and in many deals the inspection happens inside or right after this period.
  • Inspection issues get negotiated attorney to attorney, not agent to agent.
  • The buyer's earnest money is delivered and held, usually in the listing broker's or an attorney's escrow account.
  • The buyer's lender receives the fully signed contract and opens the file in earnest.

Attorney approval can be extended by written agreement. If you are the seller and you have not heard anything by day two, ask. Silence at the end of an approval period is the most avoidable delay in the whole New York home closing process.

How long does closing take in Rochester NY?

For a purchase with a mortgage, contracts here are commonly written to close roughly 45 to 60 days after acceptance, and most deals land inside that window. Cash purchases move faster because the appraisal and lender underwriting drop out, so the pace is set by title work and the attorneys' schedules. FHA and VA loans are not automatically slower, but they add an appraisal with property condition requirements, which occasionally sends everyone back to fix a peeling exterior or a missing handrail.

The closing date in the contract is a target, not a guillotine. Most residential contracts here treat it as "on or about," so a slip of a few days does not put anyone in default. That said, if you are coordinating a sale and a purchase on the same day, or you have movers booked, the difference between the 12th and the 19th is real money.

What actually pushes a closing date back?

Four things cause most delays here: lender conditions, title surprises, municipal inspections and appraisal timing. None of them are dramatic. All of them are avoidable with early attention.

  • Lender conditions. Underwriting asks for one more bank statement, one more explanation of a deposit, one more pay stub. Send documents the day they are requested, not the week they are requested.
  • Title. An old mortgage that was paid but never discharged, a judgment against someone with a similar name, an estate that never fully settled. These take days to clear once found, so the search needs to be ordered early.
  • Survey and boundaries. A new instrument survey can show a shed, fence or driveway crossing a line. Common on older lots in Brighton and the village properties around Honeoye Falls.
  • Municipal requirements. Several towns require a certificate of occupancy or a certificate of compliance inspection before transfer, and open permits from a deck, a finished basement or a replaced furnace will surface here. Call the town early and ask what they require, because rules differ from one municipality to the next.
  • Well and septic. On properties in Mendon, Rush, West Henrietta and the rural edges of the county, plan for water quality and flow testing, a septic inspection and often a pump-out. Scheduling, not the tests themselves, is what eats the calendar.
  • Appraisal. Monroe County's median sale price hit a record $308,500 in May 2026, up 7.9 percent from $286,000 in May 2025, according to NYSAR data reported by the Rochester Business Journal. In the same month, closed sales were down 17.6 percent year over year while new listings were essentially flat, 844 against 853. Fewer closings means fewer recent comparable sales in some pockets, which can slow an appraiser's report and occasionally produce a value below the contract price.

Why the closing date matters to your rate

Lenders price rate locks by length, and a longer lock generally costs more. If your closing slips past the lock expiration, you may pay an extension fee or take whatever the market gives you that week. Freddie Mac put the 30-year fixed at 6.65 percent for the week ending August 20, 2026, down from 6.67 percent the prior week and up from 6.58 percent a year earlier. The 15-year fixed was 5.95 percent that same week. Rates have been moving in small steps, so an extension is usually an annoyance rather than a disaster, but ask your loan officer what your lock costs to extend before you agree to move the date.

What sellers should be doing during this stretch

Buyers get the long task list. Sellers have a shorter one, and skipping it is what creates last-minute scrambles.

  • Get your attorney the deed, your existing survey if you have one and your mortgage information right away.
  • Request payoff figures for every lien, including home equity lines you have not used in years. An unused line still has to be closed and discharged.
  • Book the municipal inspection as soon as you know one is required, and resolve open permits.
  • Schedule any agreed repairs early and keep the receipts and permits.
  • Plan the move so the house is empty and broom clean for the walkthrough. Anything left behind that was not agreed to becomes a closing table negotiation.

Closing day itself

Most closings in Monroe County are a sit-down at an attorney's office, with the buyer, seller and their attorneys present, though remote and mail-away signings happen. The buyer brings certified funds or wires in advance. The deed is signed, the transfer documents are completed, and the deed and mortgage are recorded with the Monroe County Clerk. Possession is normally at delivery of the deed unless your contract says otherwise, so read that clause before you book the truck.

One warning that is worth repeating. Wire fraud targets real estate closings. Never accept wire instructions by email without calling your attorney's office at a number you looked up yourself and confirming every digit out loud.

Common questions

Do I need an attorney to buy or sell a house in New York?

For a residential purchase in the Rochester area, yes, in practical terms. New York closings are attorney-run, the standard contract includes an attorney approval contingency, and lenders and title companies expect counsel on both sides. Hire the attorney before you write an offer, not after, so approval does not stall while you shop for one.

Can a buyer or seller cancel during the attorney approval period?

Yes. Within that window, either attorney can disapprove the contract, and the deal ends without penalty, with the earnest money returned. It is not a negotiating tool most attorneys use casually, but it is a real exit. Once the approval period passes without disapproval, the contract is binding and your remaining outs are the contingencies written into it, such as inspection, financing and appraisal.

What happens if the appraisal comes in below the purchase price?

The lender will only lend against the appraised value, so a gap has to be closed by someone. The parties can renegotiate the price, the buyer can bring additional cash if the contract permits, the appraisal can be challenged with better comparable sales, or the buyer can cancel if an appraisal contingency applies. What you can do depends entirely on the contingency language in your contract, which is another reason to read it during attorney approval.

Can I close earlier than the date in the contract?

Sometimes. If the lender issues the clear to close early, title is clean and both attorneys and the seller can accommodate the date, an earlier closing is possible by agreement. It is not automatic, because the seller may have a purchase of their own scheduled and the payoff figures are calculated to a specific date. Ask early rather than the week of.

Who pays what at a New York closing?

Broadly, the seller pays the New York State transfer tax and their own attorney and payoff costs, and the buyer pays lender fees, title insurance, the survey, recording fees and prepaid taxes and insurance. Your attorney and your lender will each give you figures, and the Closing Disclosure from your lender lists the buyer's side line by line before closing day. Ask for an estimate in writing early so nothing on that sheet is a surprise.
